Terms & Conditions

These Terms of Use were updated on April 16, 2013, and are effective as of April 16, 2013. See the bottom of this page for any recent changes to these Terms of Use.

1. ACCEPTANCE OF TERMS

These terms and conditions (“Terms”) govern the use of the Java Code Geeks website (the “Website” or “JCG”) and the Revenue Share Program provided by JCG (the Website and related program are collectively referred to as the “Program”) and constitute an agreement between you (“You”) and Java Code Geeks as represented by their representatives Ilias Tsagklis and Byron Kiourtzoglou.

Your use of the Program, including any new services or functionality that may be made available by Java Code Geeks from time to time, is conditioned upon Your acceptance of and continued adherence to these Terms.

Java Code Geeks reserves the right to alter or revise these Terms at any time by notifying you as provided in these Terms, provided that no notice shall be required for non-substantive changes to the Terms. If we substantively amend this Agreement, we will give you at least seven (7) days notice before the changes take effect, during which period of time you may reject the changes by terminating your account with a request to JCG.

Your continued use of the Service indicates Your acceptance of any and all revised Terms. JCG reserves the right to suspend or terminate Your participation at any time or discontinue Your access to the Service or remove your Articles for any reason.

2. PERMITTED USES

The following are accepted:

  • You must do Your best to create high quality articles.
  • You must follow specific guidelines for publishing articles.
  • You may only use content to which You have the necessary rights, including (but not limited to) intellectual property rights regarding copyright, trademark, and trade secrets. This means, among other things, that You must have permission to use third party content from the content owners.

By contacting us with Your email address, You grant us permission to send communications from Java Code Geeks, such as confirmations, service announcements, administrative messages, and any of the opt-in JCG newsletters you select to that address. You may opt out of certain email communications from JCG by following the instructions on the email. You may not opt out of Service-related messages. If You do not want to receive such messages from JCG, you must cancel Your account by contacting us directly.

3. RESTRICTIONS AND PROHIBITIONS ON USE

In Your use of the Program You must abide by the following restrictions and prohibitions on use. As a Program Writer, You may Not:

Submit articles that include any content or links that are pornographic, defamatory, libelous, tortuous, vulgar, obscene, invasive of privacy, racially or ethnically objectionable, hateful, promotes or provides instructional information about illegal activities, promotes any act of cruelty to animals, or is otherwise offensive.

4. DISCONTINUATION OR MODIFICATION OF THE SERVICE

Java Code Geeks reserves the right to modify or discontinue, temporarily or permanently, the Program or any portion thereof at any time, without liability to You or any third party. In addition, JCG, in its sole discretion, may terminate Your use of the Program and remove and delete any Articles or Content, for any reason.

5. PROPRIETARY RIGHTS; CONTENT OWNERSHIP

By joining the Program, you grant ownership of the submitted content to Java Code Geeks. By submitting your article on the Program. You also grant Java Code Geeks a worldwide, royalty-free, and exclusive license, for as long as Your Content is displayed on Java Code Geeks and for a commercially reasonable time thereafter, to reproduce, publicly display, publicly perform, distribute, modify, adapt and publish the Content solely for the purpose of displaying, distributing and promoting Your Articles on or in connection with the Program.

Java Code Geeks may preserve and store Your Content and may disclose such content if required to do so by law. Since Java Code Geeks will receive ownership of the Content, requests from You to withdraw the Content from the website will be taken under consideration, but Java Code Geeks are not obliged to execute them and keep the right to decline them.

Java Code Geeks, and not the Author, will be fully responsible for all Content that is uploaded, posted, transmitted or otherwise made available by the Author on the Program (collectively “User Content”). Java Code Geeks will guarantee the accuracy, integrity or quality of User Content.

6. LINKS TO THIRD PARTY WEBSITES

Your Content may include links to other sites or resources over which Java Code Geeks has no control or responsibility. Java Code Geeks does not monitor, investigate or check these sites for accuracy or completeness. As a result, Java Code Geeks is not responsible for the content or advertising on such sites, products or other materials which they may provide, such sites’ availability, or any damages caused or alleged to be caused in connection with such external websites. All such external websites included as links or accessed by You via the Program is done at Your own risk and with Your own liability.

7. EARNING MONEY THROUGH JAVA CODE GEEKS – IMPRESSION PROGRAM

Java Code Geeks offers Authors the ability to share in impression ad revenue from third party websites (“Impressions”) by assigning Affiliate IDs.

Authors may provide an affiliate ID for a third party account (an “ID”). For example, you can provide your Google Adsense information, and Java Code Geeks will share the Impressions with such services through that ID. You are solely responsible for verifying that you have entered a valid ID correctly.

Java Code Geeks will rotate Your third party IDs into 60% of the Impressions on the Articles You create. In order to share in the Impressions, You must have a valid account from the third party provider. Impression sharing is available only for attributable Impressions – that is, Impressions that occur directly on Your Articles. These Impression-sharing services are provided subject generally to these Terms of Service, and in particular the terms in this section. There may also be additional terms imposed by the third parties with whom You choose to do business. You are responsible for ensuring the validity of the ID and the functionality of your account with the third party provider.

Under no circumstances will you receive any payments directly from Java Code Geeks. JCG only acts as a mediator by offering ad impressions.

Your use of the Impressions program on the Program constitutes Your agreement to uphold and be subject to these additional terms and conditions, as well as those that may be imposed by third parties with whom You may engage in the course of Your participation in Impression sharing services.

In the event that the Agreement is terminated by Java Code Geeks and/or Java Code Geeks elects to cease Your participation, all Your relevant ad code will be immediately removed from the JCG website.

In the event that the Agreement is terminated by You (pursuant to Java Code Geeks’s receipt of Your written termination notice) any relevant ad code of Your will be immediately removed from the JCG website. In this case, Java Code Geeks will decide whether all submitted Content of Yours will remain published. Java Code Geeks may elect to keep the Content even if the agreement is terminated.

By using the Impression services, You acknowledge and agree that Java Code Geeks will not be responsible for, and will not be obligated in any manner to repay You for, any lost earnings. Java Code Geeks makes no guarantee under this agreement regarding the amount of Earned Balance you will achieve in Your account, the revenue share, the level of Impressions, number and/or placement of advertisements, or the timely completion or delivery of any impressions, clicks, or referral information.

YOU UNDERSTAND AND ACKNOWLEDGE THAT THERE IS NO GUARANTEE THAT ANY MINIMUM LEVEL OF REVENUE, OR ANY REVENUE, WILL BE GENERATED AS A RESULT OF USING THE IMPRESSION PROGRAM AND/OR THE JAVA CODE GEEKS AD PROGRAM.

8. DISCLAIMER

THE SERVICE ARE PROVIDED “AS IS”, “AS AVAILABLE”, WITH “ALL FAULTS”, AND ALL WARRANTIES, EXPRESS OR IMPLIED, ARE HEREBY DISCLAIMED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE MAY CONTAIN BUGS, ERRORS, PROBLEMS OR OTHER LIMITATIONS. JAVA CODE GEEKS MAKES NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, OR THAT ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. ANY CONTENT DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DOWNLOADED AT YOUR OWN RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM SUCH DOWNLOAD OR YOUR USE OF THE SERVICE.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU EXPRESSLY UNDERSTAND AND AGREE THAT JAVA CODE GEEKS WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE, UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR ARTICLES, CONTENT TRANSMISSIONS OR DATA, STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE, OR ANY OTHER MATTER RELATING TO THE SERVICE. JAVA CODE GEEKS ALSO WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM YOUR FAILURE TO COMPLY WITH THE PROVISIONS OF THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JAVA CODE GEEKS ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO OR USE OF OUR SERVICE; (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN; (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY; (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICE; AND/OR (VII) USER CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY. IN NO EVENT SHALL JAVA CODE GEEKS, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE TO YOU FOR ANY CLAIMS, PROCEEDINGS, LIABILITIES, OBLIGATIONS, DAMAGES, LOSSES OR COSTS IN AN AMOUNT EXCEEDING THE AMOUNT YOU PAID TO JAVA CODE GEEKS HEREUNDER.
